General conditions of use of the RD Bled
( Fishing club Bled ) web portal

1. DEFINITIONS

The web portal www.ribiska-druzina-bled.si is a website intended for the presentation of the Bled Fishing Club, its management, the presentation of fishing districts or fishing areas, the fishing regime in each fishing area and the website for sale of fishing permits.

The RD Bled web portal enables the direct sale of fishing permits via the World Wide Web, between the service provider and the buyers of fishing permits.

The service provider and manager of the website is RIBIŠKA DRUŽINA BLED, Veslaška promenada 8, 4260 Bled, registration no. 5133521000, VAT ID SI57456445, transaction account opened with NLB, d. d. no. SI56 0209 1001 8784 897, represented by dr. Gorazd Pretnar. The association is liable to pay VAT in Slovenia.

 

2. VALIDITY OF GENERAL TERMS AND APPLICATION OF LAW

Visiting and using the web portal of the Bled Fishing Club is only permitted when the user agrees to these general terms and conditions. By entering the web portal, the user agrees to be acquainted with the general terms and conditions and to accept them in full. In the event that the user does not agree with the general terms and conditions, the use of the web portal is not allowed and the user must leave it.

The General Terms and Conditions are issued by the operator of the web portal ( FISHING CLUB BLED ) and are subject to change at any time without prior notice. Any use of the web portal is subject to the general terms and conditions in force at that time. The user is responsible for acquaintance with the general conditions in force at any given time.

3. INTELLECTUAL PROPERTY RIGHTS

The content of the web portal is entirely owned by the manager of the Fishing Club Bled. The holder of all copyright rights on the contents of the web portal, which are owned by the operator, including these general terms and conditions, is the operator and reserves them in full © Ribiška družina Bled.

4.LIMITATION OF LIABILITY

The information published on the web portal is an informative nature. The operator of the website will endeavor to ensure the accuracy, completeness and up-to-dateness of the information published on the website, but does not guarantee this.

The user uses the website of the Fishing Club Bled at his own risk. He is obliged to provide the measures for the protection of his information equipment and his information system, which are necessary for uninterrupted and secure access to the web portal (protection against intrusions, protection against viruses, etc.) and uninterrupted and secure receipt of e-mail. The user is also responsible for the protection of their data and other data transmitted via the World Wide Web. The Fishing Club Bled does not provide protection against intrusions into the user’s information system, access of unauthorized persons to user data and misuse of information equipment, information system and data referred to in this paragraph, except to the extent specified by other provisions of these general terms and conditions (eg protection of personal data – point 5).

Fishing Club Bled does not assume any guarantee regarding the storage and backup of user data published or entered on the web portal. In case of possible loss of data for the loss is not responsible.

The operator reserves the right to change, expand, add or remove the content of the web portal and / or the range of services offered by the web portal at any time and without prior notice, which includes changing the functionality of the site and / or user experience. In the case referred to in this paragraph, the user is not entitled to compensation, compensation on a different basis or compensation, but may withdraw from the contract (permit).

 

5.PROTECTION OF PERSONAL DATA

Fishing Club Bled is obliged to protect the privacy of users of the web portal in accordance with the legislation of the Republic of Slovenia and European Union law, in particular the Personal Data Protection Act and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (General Data Protection Regulation).

Fishing Club Bled will not collect any other personal data other than that provided by the user voluntarily.

The operator must collect the following information about users in connection with the provision of web portal services:

Personal information

2 Address of permanent residence

3 Email address

Information on purchases of fishing permits (number, type, time of purchase, etc.)

5 IP number of the electronic device from which the purchase was made

Fishing Club Bled undertakes to protect the collected personal data as confidential and to strive for their protection against access by unauthorized third parties. The collected personal data will be collected, processed and used by the controller only for the purposes for which they were provided to him and to the extent necessary for the operation of the web portal and the provision of services provided by the Fishing Club Bled web portal.

 

6.TERMS OF USE OF THE WEB PORTAL

The web portal and the services it offers on the user’s side are intended exclusively for natural persons over 15 years of age. Natural persons under the age of 15 are not allowed to use the portal. The purchase of a child’s permit can be done by the child’s parents or guardians. They enter the child’s data in the name and surname field. 

 

7. TECHNICAL REQUIREMENTS FOR THE USE OF THE WEB PORTAL

The use of the web portal of the Fishing Club Bled is possible only on condition that the user agrees to the use of the technologies and tools listed in this article or. procedures.

At the first visit to the web portal, it will be on the computer or. another electronic device from which the user accesses the web portal, provided that the settings of the web browser allow it, a cookie is installed (i.e. a cookie). When you visit the web portal again, the web server of the web portal will automatically access the content of the cookie stored on the user’s electronic device. Cookies do not allow the collection of personal data about the user of the electronic device on which they are stored, nor can they be used to run programs and other startup files or transmit viruses, Trojans or other malicious or unwanted program code to the user’s electronic device.

The storage of cookies is intended to collect statistics on visits to the web portal and information on which links on the web portal users use. The data is collected and processed in an aggregated manner and does not enable the identification of the way the portal is used for an individual user. In this way, Fishing Club Bled determines whether the average user receives the information he is looking for, and on this basis adjusts his services and functionality of the web portal.

 

8. CONDITIONS OF PURCHASE AND VALIDITY OF RD BLED FISHING LICENSES AND FISHING LICENSES

The web portal allows users to purchase one-day and several-day permits or. permits. Purchase of a fishing permit for selected districts or area is possible provided that the maximum quota of permits issued for the selected period has not yet been exceeded (eg for Lake Bled). Purchase is possible in Slovenian, Italian, German and English language..

The selling price of the selected fishing permit or. fishing permits are indicated for each selected fishing permit. It represents the final price of the fishing permit paid by the user, which already includes value added tax and delivery costs.

The delivery of fishing permits and licenses takes place exclusively in electronic form, via e-mail, which the user enters at the time of purchase. It is considered that the delivery of a fishing permit or. licenses are completed when the fishing permit or permission in electronic form made available to the registered user for printing.

Fishing permits are made and stored in electronic form. Fishing permit is issued by name to the user or. the person for whom the latter has purchased a fishing license is non-transferable and valid only if its holder can be identified. The registered user proves his identity with an identity document, which he is obliged to have with him during fishing and to show it to the guard service of the Fishing Club Bled.

In accordance with the regulations, the user (fisherman) proves his entitlement to fishing with a fishing permit in physical form and is obliged to immediately enter the catch in it.

The user (fisherman) is obliged to comply with the applicable regulations and rules of the Fishing Club Bled., the Freshwater Fisheries Act (ZSRib), the Rules on the fishing regime in fishing waters and the decree on fish species subject to inland fishing.

Fishing permit or. the permit contains all information in accordance with tax regulations, in particular the law governing value added tax, and is considered an invoice.

9. WITHDRAWAL FROM PURCHASE

The user may suspend the process of purchasing a fishing permit or license until payment has been made. In this case, the operator of the web portal is not entitled to charge any costs. If the payment is not made within the deadline set for the individual means of payment, the order is automatically considered canceled.

Due to the nature of the fishing permits and the method of checking their validity, it is no longer possible to withdraw from the order after the completion of the purchase (i.e. after the RD Bled information system sends the fishing permit or permit by e-mail).

In the event that the user wishes to withdraw from the purchase of a permit or authorization after the completion of the purchase, in case of extraordinary restrictions, fishing bans and other similar cases (death in the family, epidemics, diseases, etc.), the user must type or term oz. return the permit and return the purchase price directly to the support service of the Fishing Club Bled to the e-mail address support@ribiska-druzina-bled.si

The user must provide evidence to prove the exceptional restrictions that prevent him from using the fishing permit. The user must send the request and evidence at least 5 days before the start of fishing, so that the support service of RD Bled can offer the fishing permit from the quota to other users (reservations). In case of a positive solution, the manager offers the user a new term or. a new fishing permit with a new date. If the user addresses a request to the operator of RD Bled up to 5 days before the start of fishing, the operator reserves 20% of the fishing permit to cover the costs incurred in terms of reservation and unsold permit. If the club (RD Bled) withdraws from the purchase due to the closure of the lake, technical problems or for any other reasons (temperature of the river, lake, death of fish, etc.), he must return the money to the buyer of the permit to his account within 30 days.

To the user or the purchaser of the permit, which addresses the request for return / exchange, is given a new permit with a new date in the “cloud”. Cloud fishing permits do not have a marked validity date, but are shown as leased permits in the user account (user profile) on the Fishing Club Bled web portal. Leased licenses without a date cannot be printed nor do they constitute a valid fishing license. When the user selects the validity date, the information system generates a new valid fishing permit and replaces the leased permit with it. After the leased permit is replaced with a valid one based on the user’s choice of date, the change of date or the exchange of a fishing license can no longer be changed. “Cloud” fishing permits can only be issued to one holder.

 

10. SETTLEMENT OF DISPUTES

Each user is asked questions, comments and complaints, other objections, claims and statements. relating to the operation of the portal, the services referred to in point 8. or the use of these general terms and conditions, may contact the Board of Directors of RD Bled or to the e-mail address info@ribiska-druzina-bled.si

The user is obliged to address his complaints and claims to the same address before initiating proceedings before administrative or judicial bodies in order to protect his interests.

The user and the operator of the portal will try to resolve any disputes peacefully. If this is not possible, disputes arising from the relationship between the portal operator on the one hand and the user on the other will be resolved by the court with substantive jurisdiction in Radovljica.
